EFOILY.COM TERMS OF SERVICE AND SALES
These terms and conditions (hereinafter referred to as the “Terms”) govern the relationship between an individual or legal entity (hereinafter referred to as the “Client”) and Efoily OÜ (reg. code 17198443, hereinafter referred to as the “Company”, “Organizer” or “Efoily.com”) in terms of providing water entertainment and sports services, equipment rental, participation in events, purchasing subscriptions and placing orders through the online store on the website www.efoily.com.
Booking services, purchasing goods, using gift certificates and participating in events means the Client’s full and unconditional consent to these Terms and Conditions.
1. General Provisions
1.1. The Company provides electric board (eFoil) rental services, event organization services, and also sells equipment and related products through the online store.
1.2. Services are provided at the address: Nooda tee 8, Tallinn, Estonia, or at other pre-agreed locations.
1.3. The Client undertakes to use the services exclusively for their intended purpose, observing the rules of conduct, safety, instructions of the Company’s employees and the provisions of these Terms.
2. Booking and payment procedure
2.1. Services are booked through the official website www.efoily.com, by phone, email or in person on site.
2.2. Booking is considered confirmed only after 100% prepayment, unless otherwise agreed in writing with the Company.
2.3. Confirmation of booking and payment means agreement with the date, time, type of service and all related terms.
2.4. Available payment methods:
• bank card (via Stripe, Montonio, etc. payment gateways);
• cash (upon prior agreement);
• cryptocurrency (USDT, BTC, etc.) — after direct contact by email or phone.
3. Cancellation and Rescheduling Rules
3.1. The Client has the right to cancel the booking with a full refund no later than 24 (twenty-four) hours before the agreed start time of the service.
3.2. In case of cancellation less than 24 hours before the start of the session, the payment for the service is non-refundable, regardless of the reason for the refusal, including, but not limited to, illness, being late, change of plans, etc.
3.3. Rescheduling is possible once, at the initiative of the Client and subject to the availability of free slots, subject to notification of the Company at least 24 hours before the booked time.
3.4. In case of the Client being late by more than 15-20 minutes without notice, the Company reserves the right to refuse to provide the service without a refund of the funds paid.
4. Cancellation and rescheduling at the initiative of the Company
4.1. The Company reserves the right to cancel or reschedule a booking in the event of:
• adverse weather conditions (storm, strong wind, thunderstorm, low temperature, etc.),
• equipment failure,
• instructor illness or other force majeure circumstances.
4.2. In the event of cancellation initiated by the Company, the Client is offered a choice:
a) rescheduling the booking to another available date,
b) a full refund of the funds paid.
5. Responsibility and safety
5.1. Participation in classes and events occurs at the Client’s own risk. The Company takes all reasonable measures to ensure safety, but is not responsible for injuries, damage, loss or other consequences resulting from violation of instructions, safety rules or force majeure circumstances.
5.2. Each Client is required to sign a consent form (Waiver of Liability) before using the equipment or participating in the event. Participation is impossible without signing this document.
5.3. Minors aged 14 and over are only allowed in the personal presence of a parent or legal guardian, who signs the waiver on site. The presence of an accompanying person is mandatory throughout the session.
5.4. Persons under the influence of alcohol or drugs are not allowed to participate in the sessions. In this case, the service is considered rendered, no refund will be made.
5.5. The maximum permissible weight of a participant is 170 kg, depending on the board model. The responsibility for providing reliable information about their weight lies with the Client.
6. Damage to equipment
6.1. In the event of damage to equipment due to the fault of the Client (including collisions, careless handling, going beyond the permitted area, violation of instructions), the Client bears financial liability.
6.2. The damage is assessed by a representative of the Company on site based on the official prices for spare parts, repair services and / or depreciation.
6.3. In the event of a collision between two tenants, the damage may be distributed between them by agreement of the parties or based on the decision of the Efoily.com representative.
6.4. The company has the right to require a security deposit or the signing of a separate agreement on financial liability.
7. Gift certificates and subscriptions
7.1. Gift certificates are valid until September 30, 2025. Upon expiration, the certificate is canceled without compensation.
7.2. Subscriptions (for 5, 10, Unlimited flights per month) are personal, cannot be transferred to third parties, returned or recalculated.
7.3. Missed flights under the subscription are not carried over to the next month, except in cases of cancellation of sessions at the initiative of the Company.
8. Refunds
8.1. Refunds are made only in the following cases:
a) cancellation of the service at the initiative of the Client more than 24 hours in advance,
b) cancellation or impossibility of providing the service due to the fault of the Company.
8.2. Gift certificates, subscriptions, partially used packages and paid but failed visits due to the fault of the Client are not subject to return.
8.3. Refunds for goods from the online store are possible within 14 calendar days after receipt of the goods, provided that the packaging and presentation are intact. Used goods are not subject to return.
9. Personal data
9.1. The Company undertakes to comply with the current EU legislation on the protection of personal data (GDPR) and use the Client’s data solely for the purposes of providing services, marketing, feedback and improving the quality of service.
9.2. The Client gives their consent to the processing and storage of their personal data when making a reservation, order or registration.
10. Sale of goods through the online store
10.1. All goods posted in the “Online store” section on the website www.efoily.com are available for order if they are in stock or on order.
10.2. Payment is made at the time of placing the order using available payment systems. The order is considered confirmed after payment is received.
10.3. Delivery is carried out throughout Estonia, the EU and to other countries by agreement. The delivery time and cost are calculated individually.
10.4. The Buyer has the right to return the goods within 14 days from the date of receipt, provided that the packaging is intact and there are no signs of use. The costs of returning the goods are borne by the Buyer.
10.5. All eFoil boards and related equipment are covered by a 2-year manufacturer’s warranty. The warranty covers only manufacturing defects and does not cover damage caused by improper use or failure to follow instructions.
